With recourse to the teachings of Hans Kelsen and Rudolf Smend, it can be concluded how the need for justification of constitutional law should be responded to from a legal perspective, and what follows from this for legal interpretation - also for the constitutional law of the European Union.

Richard Luther studierte Rechtswissenschaften an der Heinrich-Heine-Universität Düsseldorf und der University of Hull im Vereinigten Königreich Großbritannien und Nordirland. Nach dem Studium arbeitete er als wissenschaftlicher Mitarbeiter am Lehrstuhl für deutsches und europäisches Verfassungs- und Verwaltungsrecht von Herrn Prof. Dr. Heiko Sauer an der Rheinischen Friedrich-Wilhelms-Universität Bonn. Derzeit lebt und arbeitet er in Köln.
